Kegler Brown’s annual Managing Labor and Employee Relations seminar will take place both in person and virtually on Tuesday, May 6, 2025. This year’s seminar will focus on timely information regarding labor and employee relations, and offer CLE and SHRM credit hours.

  • 8:30 a.m. Independent Contractors vs. Employees: Avoiding Workers' Compensation Pitfalls  |  Jacob Dobres
    Understanding the distinction between independent contractors and employees is crucial for compliance with workers' compensation laws. Employers must evaluate the degree of control they have over workers, the nature of the work, and the contractual agreements in place. Misclassification can lead to significant legal and financial consequences, potentially including recalculation of workers' compensation premiums and penalties. This presentation will delve into the criteria used to determine worker status, the implications of misclassification, and best practices for ensuring compliance.

  • 9:30 a.m. Dispute Resolution Dynamics: Litigation, Arbitration + Waivers  |  Nicholas Bobb
    Choosing between litigation and arbitration can significantly impact the resolution of employment disputes. Arbitration is often seen as a quicker and more cost-effective alternative to litigation, but it comes with its own set of challenges, including enforceability of collective class action waivers. This presentation will compare the pros and cons of litigation and arbitration, explore the legal landscape surrounding class action waivers, and provide guidance on drafting enforceable arbitration agreements. Attendees will gain insights into making informed decisions about dispute resolution strategies.

    The rise of remote work has made it easier to hire talent anywhere in the U.S. But as workforces expand across state lines, many employers face challenges with new and competing state and local employment laws. Employers must navigate complex issues such as taxes, leave, PTO, overtime, and other employment regulations. This presentation will provide an overview of the key legal considerations, strategies for managing compliance, and the potential risks of non-compliance. Attendees will learn how to develop policies that accommodate expanding workforces while adhering to state-specific requirements.

  • 11:15 a.m. Managing the Manager: What to Do When the Bos Isn't Bossing |  Brendan Feheley
    Properly disciplining and discharging management and supervisor-level employees is often times a tricky task. This presentation will cover how to document managers' lack of performance, what to do when documentation isn’t readily available, and the legal considerations surrounding severance pay and other termination benefits. Attendees will learn best practices for conducting disciplinary actions and terminations, ensuring compliance with employment laws, and protecting the organization from potential litigation.

There is a $75 fee to attend this program in person. The in-person program will be held at the Fawcett Center (2400 Olentangy River Road, Columbus, OH 43210). A full breakfast buffet will be provided to in-person attendees.
