Nothing in this Privacy Notice should be understood as creating an attorney-client relationship with visitors to our Websites or, alternatively, to reduce of the protections resulting from such relationships.

This Privacy Notice applies to personal data we collect on or through the Websites, in email, text, and other electronic messages between you and the Websites, or in person or otherwise offline.

Children Under the Age of 18

Our Websites are not intended for children under 18 years of age. If we learn we have collected or received personal data from a child under 18 through the Websites without verification of parental consent, we will delete that information. Cross-Border Transfer

If you are located in the European Economic Area (EU Member States, Iceland, Liechtenstein and Norway, collectively the “EEA”), and/or the United Kingdom, Brazil or otherwise outside of the United States (each such user, a “Global User”, you acknowledge the Websites and information processed on and through the Websites or otherwise may be stored and processed in the United States. Please be aware that information we collect may be transferred to and processed in the United States. By using the Websites or providing us with any information, you acknowledge this transfer and the processing of information in the United States.

Protected Health Information

Our Websites, emails, and other communications may include links to other sites, features, functionality, and other technology operated by third parties, including among others cookies, pixels and other tags, scripts, and trackers and may be used in connection with social media, professional networking, and other websites and services and as otherwise disclosed or permitted. By way of example and without limitation, when you follow a link from our Websites to a LinkedIn article or other third-party site. By making such links or other access to such sites, features, functionality, and technology available we do not imply that we endorse or have reviewed such items or the content thereof. The information that you share with these sites will be governed by the specific privacy policies and terms of these third-party sites and not by this Privacy Notice. Please contact those sites directly for information on their privacy practices and policies. By way of example, the Websites use Google Analytics, a web analytics service provided by Google LLC (“Google”). Google Analytics enables Google and its wholly owned subsidiaries to link information about your activity from our Websites with activity from other sites or apps. Google indicates that a disclosure of how Google Analytics collects and processes data is available under the “How Google uses data when you use our partners’ sites or apps” heading, (located at https://policies.google.com/technologies/partner-sites).   • Do Not Track. You may be able to set your browser to refuse all or some browser cookies, or to alert you when cookies are being utilized; however, due to the varying practices of organizations that offer browsers and the lack of a standard in the marketplace, we generally do not respond to do not track (“DNT”) signals sent via browsers at this time. In general, our system will issue certain essential cookies when you direct your browser to our Websites. 
  • Promotional Offers from the Company. If you do not wish to have your email address/contact information used by the Company to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to privacy@keglerbrown.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions or use the opt-out links or related functionality made available through the communication.

Your Privacy Rights

In the event you provide personal data on or through our Websites or otherwise make available personal data while located in the EEA, you may have certain rights under the EU General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”) and other laws, and if you are a resident of any of the following states (CA, CO, CT, DE, IN, IA, KY, MD, MN, MT, NE, NH, NJ, NV, OR, RI, TN, TX, UT, VA), subject to applicable exceptions, including but not limited to attorney-client privilege and legal requirements, you have the following privacy rights with respect to the personal data we collect:

  • The right to opt out of the sale or sharing of personal data. To exercise your right to opt-out of the sale of personal data or sharing of personal data for cross-context behavioral advertising, a consumer may click or tap the Do Not Sell or Share My Personal Information link at the bottom of the Website[DW11.1][MM11.2][DW11.3], and an action panel will appear where the user may click or tap Do Not Sell or Share My Personal Data in the footer of the Website, then click or tap the Confirm My Choices button. We do not have actual knowledge that we sell or share personal data of minors under the age of 16.
  • The right to be informed. You have the right to be informed about the personal data we collect from you, and how we process it.
  • The right of access. You may request a copy of the personal data we are processing about you.
  • The right to correct. You have the right to request your personal data be corrected, if it is inaccurate or incomplete.
  • The right to delete (right to be forgotten). You have the right to request the removal or deletion of your personal data that we process about you.
  • The right to data portability. You have the right to request that when exercising your right of access that we transmit the applicable personal data in a readily usable format that allows the transmission of the data to another entity to the extent technically feasible.
  • The right to opt-out of automated individual decision-making and profiling. You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
  • Right to file a complaint. If you are in the EEA, and you believe we have not complied with the applicable data protection laws, you also have the right to file a complaint with the local data protection authority.   • Right not to receive discriminatory treatment. You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights.
  • Additional rights for Global Users. As applicable, if you are a Global User, you have a right to: (A) request that we restrict our processing of your personal data where: (i) such data is inaccurate, (ii) our processing is unlawful, or (iii) we no longer need to process such data for a particular purpose and we are unable to delete the data due to a legal or other obligation, or (B) object to us processing your personal data if the processing is based on our legitimate interest, and where we are processing your personal data pursuant to the lawful basis of consent, you have the right to withdraw such consent at any time, without charge. This includes, without limitation, your ability to opt-out from marketing messages that you receive from our affiliates.

Opt-Out Preference Signal OOPS/Global Privacy Control

You may also exercise your right to opt-out of the sale of personal data or sharing of personal data for cross-context behavioral advertising, through the use of an opt-out preference signal in a frictionless manner.

Specifically, our Websites recognize the Global Privacy Control signal (“GPC”), when enabled in the browser used to access our Websites.

When GPC is enabled on your browser, our Websites will treat that browser as having exercised the right to opt-out. If you visit the Websites from a different browser, GPC must be enabled on such browser, as well, or you will need to manually opt-out as described below.

To verify your automated request was honored, you may click or tap the “Do Not Sell or Share My Personal Information” link in the footer of our Websites. An “Opt-Out Instructions Below” slide out will appear from the right. If GPC is honored, a green checkmark will appear at the top of the slide out.

A consumer may click or tap the Do Not Sell or Share My Personal Information link in the footer of the Website, and an action panel will slide out from the right where the user may click or tap Do Not Sell or Share My Personal Data button and the action panel will automatically hide after honoring your request. We do not have actual knowledge that we sell or share personal data of minors under the age of 16.

Exercising Your Privacy Rights Directly or through an Authorized Agent

You or your authorized agent may make a request to exercise your rights. If you are an authorized agent, you must first send us an email at privacy@keglerbrown.com, including a signed document indicating that you are authorized to act on behalf of the individual, with the words “Authorized Agent Privacy Request” in the subject line of the email, and promptly respond to our follow-up questions. You may opt out of the sale or sharing of your personal data as described above. 

To make a request to exercise another privacy right, please submit a request by emailing us at privacy@keglerbrown.com, with the type of request in the subject line of the email, and promptly respond to our follow-up questions.

We may ask for specific information to help us validate your request.

In addition to the forgoing rights, you may opt out of receiving marketing and market research communications at any time by using the unsubscribe links provided in the communication, as applicable, or by contacting us at privacy@keglerbrown.com.

For the avoidance of doubt, Nevada consumers who wish to exercise their privacy rights under Nevada Revised Statutes Chapter 603A may do so at the designated request addresses described above. 

California Shine the Light and Additional Information for California Residents

California Civil Code Section § 1798.83 permits users of our Websites that are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. We do not process sensitive personal information of California residents for purposes that require us to offer California consumers a “right to limit” the use or disclosure of sensitive personal information.

Changes to Our Privacy Notice

We may amend this Privacy Notice at any time at our discretion by posting the changes on the Website. If we make material changes to how we treat our users' personal data, we will notify you through posting on the Website. Your continued use of the Website following the posting of changes constitutes your acknowledgement of such changes.
