Leading Kegler Brown's talented IP team, Jeff manages large, global IP portfolios, serving as a strategic advisor to his clients in both establishing, growing, and licensing their marks, as well as managing disputes and administrative hearings related to trademark and copyright infringement, trade secret protection, and related litigation.

Jeff’s broad practice is also focused on helping business owners and in-house counsel teams navigate complex issues related to regulatory compliance for advertising and promotions.

Business

Jeff offers creative and efficient strategies that are tailored to meet his clients’ needs throughout every stage of the business life cycle, including entity formation and structuring, contract drafting and negotiation, and licensing. He helps clients achieve their goals and protect their businesses through his knowledge of various agreements, including confidentiality agreements and NDAs, operating agreements, licensing agreements, and purchase and sale agreements.

Intellectual Property

Jeff focuses his intellectual property practice on identifying and protecting clients’ intellectual property interests through market planning and due diligence, use of trademarks, copyrights, and software agreements, implementation of trade secret protection procedures, and license drafting and negotiation.

Jeff also advises clients on domain dispute issues and has experience using the ICANN/UDRP process to force transfer of contested domains.

Advertising

Jeff also counsels clients on advertising strategies to avoid intellectual property pitfalls and undesired attention of governmental authorities. From approving ad copy to navigating international spam guidelines and implementing endorsement policies, Jeff’s practice focuses on keeping businesses in compliance with regulatory agencies such as the FTC and FCC, as well as providing practical advice for businesses operating in “grey” areas of the law. He advises clients on issues ranging from social media policies, product labeling requirements, advertising claims and representations, and more.

Domain Name Disputes

Jeff Nein maintains a dedicated practice focused on the protection of his clients’ domain names. Jeff’s experience in resolving domain name disputes is broad and includes the resolution of challenges pertaining to domain name issues, including:

Jeff has developed a reputation for aggressively protecting and enforcing his clients’ rights when faced with competitors or other bad actors seeking to unfairly profit from or disrupt his clients’ businesses. He defends clients against such bad actors who register domain names that are similar to trademarks owned by his clients with the intention of ransoming the domain name, diverting traffic to their own site or simply diverting traffic away from his clients’ digital assets. He also defends against reverse domain name hijacking efforts by others, and counsels his clients regarding all other disputes in which another party asserts legal rights to his clients’ domain names. In all cases where domain names are inappropriately registered to and owned by another party, Jeff works aggressively to restore these misappropriated assets to his clients.

Depending on the circumstances of the specific domain name dispute, Jeff represents his clients in filing claims under the Uniform Domain Name Dispute Resolution Policy (UDRP) as instituted by the Internet Corporation for Assigned Names and Numbers (ICANN). Jeff is adept at influencing decision makers, which often allows his clients to avoid costly litigation. However, should litigation ensue, Jeff stands ready to advocate his client’s position in court or any other forum if it is in their best interest to do so.

Upon joining Kegler Brown’s IP Strategy + Consulting practice, Jeff quickly became fully immersed in intellectual property law and is the only attorney at the firm with a core focus on domain name disputes.
