Lease Dispute with Prominent Central Ohio Restaurant
Kegler Brown’s litigation team successfully represented a central Ohio real estate investment company in a complex lease dispute against a well-known restaurateur who had leased a highly visible property from the client. The dispute involved the tenant’s claim that its monthly lease payments were instead payments toward the purchase of the property itself, while our client maintained that the payments had always been remitted under the terms of a traditional lease agreement.
When the tenant began defaulting on its lease obligations, our firm initiated an eviction action to take control of the premises. Upon trial, the court ruled in our client’s favor, confirming a month-to-month oral lease and granting our client possession of the property. The tenant’s subsequent appeal was denied.
