Contractors on OSFC School Projects Must Sue in Court of Claims

The Fourth District Court of Appeals has ruled that contractors with disputes on projects funded in part by Ohio School Facilities Commission (“OSFC”) funds utilizing the standard OSFC contract cannot sue the local School District in the Common Pleas Court. Ingle-Barr, Inc. v. Eastern Local School District, Case Nos. 10CA808-809 (Jan. 27, 2011). Instead, the contractor’s remedy is to sue the OSFC (not the School District) in the Court of Claims.
