Contractors on OSFC School Projects Must Sue in Court of Claims
Kegler Brown Construction Newsletter February 1, 2011
The Fourth District Court of Appeals has ruled that contractors with disputes on projects funded in part by Ohio School Facilities Commission (“OSFC”) funds utilizing the standard OSFC contract cannot sue the local School District in the Common Pleas Court. Ingle-Barr, Inc. v. Eastern Local School District, Case Nos. 10CA808-809 (Jan. 27, 2011). Instead, the contractor’s remedy is to sue the OSFC (not the School District) in the Court of Claims.
Eric Travers of our office made the winning argument for the School District in this case.
