As long as you have employees, litigation is almost a foregone conclusion. The employer’s best defense is always documentation. As part of our 2023 Managing Labor + Employee Seminar on May 24, Nick discussed the ways employers should document any problematic employees or workplace incidents so that their records can be helpful, rather than harmful, in future litigation. He gave examples of both good and bad documentation practices and illustrated how each can affect an employer’s position against a former employee in a lawsuit.
