Mitigating Litigation Risk

On November 1, John Brody and Saša Trivunić spoke to the Ohio Credit Union League about some of the important basics of litigation, as well as strategies for limiting the risk of litigation. Focusing on the relationship between jurisdiction and venue, they explained the different types of jurisdiction and its impact on the venue. They discussed proper venues with a close look at Ohio Rule of Civil Procedure 3(C), as well as the possible outcomes of an improper venue. Using case studies, they described the invalidation of a forum-selection clause, then discussed alternative dispute resolutions, and the fundamentals of mediation and arbitration.
