Contract Statute of Limitations Shortened From 15 to 8 Years

Ohio has long had a 15-year statute of limitations for written contract claims. Many Ohio businesses have criticized such a lengthy statute of limitations, which requires recordkeeping over a prolonged period of time.

The Ohio legislature, effective on September 28, 2012, reduced the written contract statute of limitations in R.C. 2305.06 to eight years, instead of fifteen. With respect to claims that accrued prior to the effective date of the change, the period of limitations shall be eight years from the effective date of the act, or the prior statute of limitations, whichever expires first.

This change should provide some limited relief to companies charged with preserving project records, or concerned about construction defect claims.
