Receivership Experience

Matt has been working with receiverships for more than fifteen years, representing receivers, lenders, and creditors in receivership proceedings. In 2005, in advance of significant revisions to the U.S. Bankruptcy Code, Matt was on the cutting edge of developments as an author promoting receiverships as a restructuring alternative. He was interviewed by The Deal magazine to discuss how a state or federal receivership proceeding could be used, in lieu of bankruptcy, to protect creditors, stabilize operations, revive businesses or, if necessary, to liquidate collateral. Ten years later, Matt continues to help clients navigate receivership proceedings that are being used for those very purposes.

With respect to receivership issues, Matt brings a wealth of knowledge, combined with a practical and efficient approach to work, to his client relationships. Matt has been involved in numerous business and asset sales, including many court-approved "free and clear" sales. In Ohio, he has worked closely with receivers in Ashland County, Crawford County, Cuyahoga County, Harrison County, Huron County, Lake County, Medina County, Portage County, Stark County, Summit County, and Trumbull County. He has also assisted a receiver appointed in Michigan and has consulted on many pre-receivership matters.

Matter: Aurora Recreation LLC v. Aurora Golf & Country Club, Inc., et al. (Portage County)
Representation: Represented the court-appointed receiver in the golf club's receivership proceedings, which culminated in a court-approved "free and clear" sale of assets.

Matter: Bainbrook Homeowners Club v. Aurora Management, Inc., et al. (Summit County)
Representation: Represented the court-appointed receiver in proceedings, which culminated in the recovery of a variety of assets and multiple court-approved "free and clear" sales.

Matter: Bank of the West v. The Wellness Works In Solon, Ltd. (Cuyahoga County)
Representation: Represented the court-appointed receiver in a health and wellness company's receivership, which culminated in the parties' working out a consensual resolution.

Matter: First Merit Bank, N.A. v. Blue Island Land Co., LLC, et al. (Cuyahoga County)
Representation: Represented the court-appointed receiver in a land development company's receivership, which culminated in the parties' working out a consensual resolution.

Matter: FirstMerit Bank, N.A. v. Pramukh, Inc., et al. (Cuyahoga County)
Representation: Represented the court-appointed receiver in proceedings, which culminated in a court-approved "free and clear" sale.

Matter: FirstMerit Bank, N.A. v. Shepherd's Properties, LLC, et al. (Lake County)
Representation: Represented the court-appointed receiver in proceedings, which culminated in court-approved "free and clear" sale.

Matter: In re: Receivership of Taylor & Smith, Inc. (Michigan)
Representation: Represented the court-appointed receiver in an online retailer's receivership and assisted with the wind-down of its business and various asset sales.

Matter: KeyBank N.A. et al. v. Automatic Welding and Manufacturing Co. (Ashland County)
Representation: Represented the court-appointed receiver in a manufacturer's receivership, which culminated in the receiver's maintaining operations and selling the company's assets in a court-approved "free and clear" sale.

Matter: Metal Exchange Corporation v. Ravenna Aluminum, Inc. (Portage County)
Representation: Represented the court-appointed receiver in a manufacturer's receivership, which culminated in a court-approved "free and clear" sale of substantially all the assets.

Matter: RBS Citizens, National Association v. Cadiz, Ltd., et al. (Harrison County)
Representation: Represented the court-appointed receiver in proceedings, which culminated in a court-approved "free and clear" sale.

Representation: Represented the court-appointed receiver in proceedings, which culminated in multiple court-approved "free and clear" sales.

Matter: Truliant Federal Credit Union v. Kontur LLC, et al. (Summit County)
Representation: Represented the court-appointed receiver in proceedings, which culminated in multiple court-approved "free and clear" sales.

Matter: Westfield Bank, FSB v. Miller, et al. (Summit County)
Representation: Represented the court-appointed receiver in proceedings, which culminated in the recovery of a variety of assets and multiple court-approved "free and clear" sales.
