Proposed Changes to HIPAA Privacy Rule Released May 31, 2011

The Department of Health and Human Services ("HHS") issued a Notice of Proposed Rulemaking ("NPRM") on May 31, 2011, concerning changes to the Health Insurance Portability and Accountability Act  ("HIPAA") Privacy Rule. The proposed changes were required by the Health Information Technology for Economic and Clinical Health Act ("HITECH"), which was adopted in 2009.
 
Changes include a more detailed accounting of disclosures that are likely to affect an individuals' privacy rights or interests. The additional accounting burden falls upon covered entities and their business associates. HHS is receiving comments on the NPRM until August 1, 2011.
