Successful Defense of Age Discrimination Charges in EEOC Case

Our firm defended DuneCraft, Inc. from charges of age discrimination raised by its former Logistics and Accounting Manager. The Equal Employment Opportunity Commission retained the matter and brought the charges of disparate treatment due to age, hostile work environment because of age, and retaliatory termination in U.S District Court, Northern District of Ohio before Judge Gwin. Discovery and dispositive motion practice lasted for 11 months before the case proceeded to a jury trial. After prevailing on numerous motions in limine to eliminate much of the claim for damages and to prevent the introduction of potentially prejudicial testimony and documents, the trial was reduced to two days and included testimony from 10 witnesses. The twelve jurors (7F 5M) deliberated for 2+ hours and returned a unanimous verdict in favor of DuneCraft on all counts.
