Implications of the Proposed "Employee Free Choice Act"

The euphemistically titled "Employee Free Choice Act" is a federal bill that was passed in the U.S. House of Representatives in March 2007, but did not pass in the Senate under the current administration. President-elect Obama supports the union-sponsored bill and has incorporated it as a priority for his first 100 days. As written, the EFCA will:
- Dramatically reverse the rules of union organizing that have stood for 40 years;
- Allow unions to become the exclusive representatives of employees without secret ballot elections;
- Take away an employer’s right to bargain for economic terms it can accept, substituting instead binding arbitration; and
- Significantly increase penalties for employer unfair labor practices during organizational campaigns.
All signs are that unions are starting to organize now, anticipating the bill’s passage early next year.
